On the 1 July 2020, amendments to the Victorian OHS Act will come into force. These amendments relate to Workplace Manslaughter. Other jurisdictions have also created similar legislation in response to pressure from community and various lobby groups where it was perceived that the existing legislation did not provide sufficient penalty or deterrence following a death at a workplace. These amendments will allow for prosecution of a person, a body corporate, an unincorporated body or association or a partnership, including government entities and officers of these entities (but not employees or volunteers). The legislation is centred around an accused being “criminally negligent” in their breach of the duty of care under existing sections of the OHS Act (where this breach has caused the death). This is the existing common law test of causation. If convicted the maximum penalties that can be applied are:- 20 years imprisonment for individuals
- $16.5M fine for body corporates
