Mediation is an informed, voluntary and confidential process, where participants have agreed to attend in good faith with the aim of obtaining a mutually satisfactory resolution to their dispute.
Why mediation?
Mediation has proven to be an effective method of returning injured workers back to work in a timely and cost effective manner. Mediation is more ‘user-friendly’ than litigation and it has a proven success rate. It is informal and, if successful, provides a cheaper and quicker means of settling a dispute. The financial and emotional costs are also significantly reduced by a successful mediation.
Mediation can help the relationship between parties to survive their dispute because it allows them to formulate their own mutually acceptable solutions. Thus assisting injured workers return to the workplace with ownership over the dispute resolution.
What does the mediation process involve?
Mediation is normally divided into two sessions – a preliminary conference and a mediation session. The purpose of the preliminary conference is to explain the features of the mediation process, determine the preliminary steps to be taken before the mediation conference.
During the mediation conference parties have an opportunity to give a brief opening statement outlining their individual concerns and issues. The mediator then encourages the parties to communicate directly to enable them to clarify their position with the other side and to gain an understanding of the other party’s point of view. This process opens the channels of communication and assists in repairing damaged relationships.
The entire Mediation process generally takes 4-8 hours.
Who are the mediators?
A mediator appointed by Recovre is a neutral third party who assists the parties to discuss, negotiate and achieve a solution that both parties have agreed upon. Recovre has fully accredited mediators who have undergone specific and advanced mediation training. The mediators at Recovre are all fully registered psychologists who have extensive experience in the workers compensation sector.
